6ix9ine Legal issues
In October 2015, Hernandez pled guilty to one felony count of Use of a Child in a Sexual Performance. He was charged with three counts for the offense after a February 2015 incident where he had sexual contact with a 13-year-old girl and later distributed videos of the incident online. Three videos are described in the criminal complaint against Hernandez. In the first video, “the child engages in oral sexual intercourse with the separately charged defendant Taquan Anderson, while the defendant, Daniel Hernandez, stands behind the child making a thrusting motion with his pelvis and smacking her on her buttocks. The child is nude in the video.” The other videos show the child sitting on the lap of Hernandez while Anderson gropes her breasts, and later sitting naked across the laps of Anderson and Hernandez.
In a November 2017 interview, Hernandez claimed to have “no sexual contact” with the girl and denied knowing she was a minor. He also claimed to have been a minor, 17 years old, at the time of the incident, although the birth date listed in the complaint against him and his statement to the police shows he was eighteen at the time.
Under his plea deal, Hernandez must obtain his GED, refrain from posting sexually explicit or violent images of women or children to social media, and not commit another crime for two years, among other injunctions. If met, the plea deal would give Hernandez three years probation, and he would not have to register as a sex offender; if not, Hernandez could face up to three years in prison. In a January 2018 court hearing, it was revealed that Hernandez had failed his GED test, but had his sentencing adjourned until April 10, 2018. The court date was later postponed, reportedly because the court did not have a copy of Hernandez’s GED. Before his sexual misconduct charges, Hernandez served jail time as a minor for assault and the sale of heroin.
On July 12, 2018, Hernandez was arrested in New York for an outstanding warrant related to an incident where he allegedly choked a sixteen-year-old in Houston’s Galleria Mall in January 2018.
6ix9ine Pistol Whipped
In the early morning hours of 22nd July 2018, Hernandez was kidnapped, beaten, and robbed by three unknown assailants. He had finished shooting a music video when three armed assailants grabbed Hernandez outside of his home and pistol-whipped him. The robbers eventually took over $750,000 in custom jewelry and approximately $35,000 in cash. Hernandez escaped from their vehicle and summoned police help via a stranger, after which he was taken to the hospital. At the time of the incident, his daughter and the Baby Mama were in the house though they were not harmed. This came after the release of the new music video featuring Nicki Minaj “FEFE”, released on the same day.
6ix9ine arrested on robbery, racketeering and firearms charges
6ix9ine is accused of being a member of “a violent sect of the Bloods” gang in November 2018. Four of his associates were arrested on Saturday, 18th November 2018. They include his ex-manager Kifano “Shottie” Jordan, plus Faheem “Crippy” Walter, Jensel “Ish” Butler and Jamel “Mel Murda” Jones, who were members of 6ix9ine’s security team. These four face separate drugs charges of selling heroin, fentanyl, MDMA, and marijuana.
There is also a charge of armed robbery after an incident in April, in which the group is alleged to have robbed a rival gang at gunpoint in Times Square, New York. Items said to have been stolen in the robbery were found at 6ix9ine’s home during a search in September. 6ix9ine is also alleged to have filmed the robbery.
Prosecutors summed up the charges as encompassing “narcotics distribution, acts involving violence, and the use of firearms, in music and on social media … The purposes of the Enterprise included preserving and protecting the power, territory, and profits of the Enterprise through acts involving murder … and threats of violence.” The robbery charge has a seven-year minimum sentence, while the collected racketeering charges carry a 25-year minimum sentence if convicted.
6ix9ine faces racketeering charges as a result of his alleged activity with gang members. One of the most serious is a charge of conspiracy to commit murder: an innocent bystander was shot in an incident in July – fallout from an alleged plan to shoot someone the gang saw as disrespecting them. On another occasion, one of the group is said to have fired shots inside the Barclays Centre in Brooklyn, with no one injured. 6ix9ine is also being charged for the illegal ownership of an AR-15 semi-automatic rifle.
